Letter of administration

1) What should you do if the deceased does not leave a Will?
You will have to engage a lawyer to apply for Letters of Administration.

2) What are the documents that are required to apply for Letters of Administration?
You have to prepare the following:-
1. death certificate of the deceased;
2. the copy of the identity card of the deceased;
3. copies for all the beneficiaries’ identity cards;
4. copies for all the beneficiaries’ birth certificates/marriage certificate (depending who is the deceased);
5. the documents for all the assets that are belong to the deceased; and
6. any other relevant documents.

3) What is the brief procedure to apply for Letters of Administration?
1. You will have to appoint an Administrator.
2. The Administrator and all the beneficiaries will have to sign the documents.
3. The Court will fix a hearing date which the Administrator will have to attend to the Court.

4) What is an Administrator?
The Administrator is someone who represents the deceased and helps the deceased to administer all the estate belongs to the deceased.

5) How is the estate of the deceased distributed?
It will be distributed according to the Distribution Act 1958.
